Had a moment this AM to share some wisdom on the absurdity of clerkship hiring -- recounted an interview in which (1) the judge asked me a question from Thinking, Fast and Slow; (2) I got it right; and (3) he then accused me of lying about never having heard the question before.

Compare here, where Trump's Alien Enemies Act proclamation says he's targeting Venezuelans who "are members of TdA." Nothing in this proclamation actually gives the president unreviewable discretion to say who is or isn't a member of Tren de Aragua and proceed accordingly. /5

But this was their explanation for *why* they didn't assess whether internees were dangerous. It was based on the way the Alien Enemies Act proclamation was written; the president wasn't interning people who "were" dangerous but instead those who had been "deemed dangerous." /4
