Happy to share my experiences. I had some really terrific SJA’s at NTC, 3ID, FORSCOM and USFK. Had some very thorny/contentious cases. Occasionally the SJA would bring in the deputy or Chief of Justice or Special prosecutor so those junior SJAs could witness the rigorous discussion.

No one should be satisfied with lengthy processing, but in the end the soldier should know they had due process and their opportunity to plead their case with the CA.

Staffing time is a function of a lot of things like staffing shortages. I looked at as ensuring due process. That is important for credibility of the judicial system. For me, I rigorously reviewed every page of a packet, lengthy discussions with the SJA and met with the soldier before disposing.

As a GCMA (1-star and 2-star command) I withheld disposition for any E8 and above alleged misconduct. Frankly I had enough on my plate without pulling up E7 as well.

As a BCT Cdr 2003-2005 I withheld disposition of any alleged sexual misconduct at my level for any E6 or above. My actions in disposing of cases sent a clear message of important I felt holding people accountable for these were essential to good order and discipline.

I think that is one of the reasons for withholding disposition authority. Another consideration is type of punishments available if soldier is found guilty/or allegation substantiated. More options at GCMA then at SPCCMA.

2. We do not have a formal ldr development model for teaching/coaching/develop judicial temperament for our convening authorities. Cdrs develop it on their own based on what they watched their CDRs do when they were LT/CPT/Majors and listening to their BCT trial counsels.

Couple of observations: 1. The investigative culture that really blossomed CIRCA 2006 has produced risk aversion and investigation exhaustion which was not the intent. Risk aversion is primarily because of allegations of “failure to act” so now we have CYA. All with no additional resources.
