A culture of meaningful accountability would have gone a long way to prevent this. But LEOs have been included in the elite impunity club, so a guy like this gets to break the law and still be allowed to enforce it at his discretion.
Paragraph four of the civil rights complaint in the quoted post, which reads, "O'Connell is an officer with a documented history of volatility and poor judgment, having previously been terminated from the St. John's County Sheriff's Office for threatening to "blow up" the agency, later reinstated, then arrested for domestic battery before resigning under the weight of those charges. Jacksonville Beach PD hired him anyway, assigned him as lead investigator on a sensitive child-luring case, and later promoted him to corporal after his investigation resulted in the wrongful arrest and prosecution of an innocent man."

I’m kind of curious how/why Monroe County gained population, and if Mon County’s population growth will continue as WVU struggles.

Why would you not challenge this? There are a lot of defense attorneys that are simply far too credulous.

An excerpt from a Connecticut Supreme Court case that states: “We next had occasion to consider eyewitness identification evidence in Dickson. We held that, contrary to our prior case law on the topic, ‘in cases n which the identity is an issue, in-court identifications that are not preceded by a successful identification in a nonsuggestive identification procedure implicate due process principles, and, therefore, must be presented by the trial court. . . . We reasoned that ‘we are hard pressed to imagine how there could be a more suggestive identification procedure than placing a witness on the stand in open court, confronting the witness with the person whom the state has accused of committing the crime, and then asking the witness if they can identify the person who committed the crime.”

The Heritage Foundation’s policy positions: 1) requiring a permit to own a gun is government overreach and an infringement on personal liberty; and 2) the government should be able to dictate when, how, and who has sex. Really great group.

This footnote, in particular, makes me want to vomit. I have way to much to say about everything in this footnote and what it assumes about how any court this country treats a given habeas petition.
A footnote from a 5th Circuit Court of Appeals opinion dissenting to the court’s decision and discussing habeas corpus cases. The footnote reads: 'It is baseless to suggest, as a panel of our court did, that overdetained prisoners cannot get habeas relief. See Hicks v. LeBlanc, 81 F.4th 497, 509 & n.76 (5th Cir. 2023). It is of course true that a would-be § 2241 petitioner like McNeal would have to exhaust his remedies in state court first. See Thomas v. Crosby, 371 F.3d 782, 812 (11th Cir. 2004) (Tjoflat, J., specially concurring) (" Although there is a distinction in the statutory language of 8s 2254 and 2241, there is no distinction insofar as the exhaustion requirement is concerned."). But we have no basis to think the state courts would have turned a blind eye to a properly filed habeas petition. And even if they did, the federal courts certainly would not have. Cf. 28 U.S.C. § 2254(b)(1)(B)(i)-(ii). . .
