While this ruling is concerning enough it’s in my eyes important - and should be part of the headline - to note that the Court did not rule on the lawfulness of the executive order or the measures. The ruling was purely on procedural grounds. The Court mentioned this explicitly. Bad enough though.

Schon die Ausgangsfrage ist ziemlich blödsinnig. Es sei denn, man begreift Wirtschaft als „das, was wir gerade tun, so, wie wir es gerade tun“. Wir könnten uns ja auch auf die Zukunft, ihre Herausforderungen und Möglichkeiten einlassen. Aber dafür müsste man ja eine Vorstellung davon entwickeln.
