...and Congress should reclaim responsibility for rulemaking. Rules increasingly make substantive policy choices hard to distinguish from legislation. Agencies should handle technical implementation, but major rules should require legislative approval. That would fit with the post-Chevron framework.

Rulemaking is lawmaking. The rulemaking functions of executive branch agencies should be relocated into Congress. Move the staff and the budget.

Rulemaking is lawmaking. With Chevron and Humphrey’s Executor gone, Congress should stop outsourcing that work to agencies controlled by the President. Build expert rulemaking capacity in the legislature, adopt rules publicly, and leave agencies to administer and enforce.
