As the Supreme Court said of Lafayette Park, "Although originally part of the White House grounds, President Jefferson set it aside as a park for the use of residents and visitors" and is in fact "visited by vast numbers of visitors from around the country" and the DC area.

Both the Park and the Mall were included in Major Pierre L'Enfant's original plan for the Capital. Both are visited by vast numbers of visitors from around the country, as well as by large numbers of residents of the Washington metropolitan area."

Again, let's just stop & remember that age-based legal restrictions on access to social media/online services are a bad idea & infringe the rights of young people to speak, access information and arts & culture, find community and play. Then look at the madness involved in trying to make them work.

The 1st Amt right of equal access to the government's public statements has been applied in many different contexts by courts across the country for years. We've been arguing that it be applied to official government social media posts since at least 2018. Here it is squarely before the court.

Yep. It will be interesting to see if Meta's behavioral inference meets the accuracy standards it agreed to in the Settlement (which are only concerned with young people being falsely identified as adults -- no standards for adults being falsely identified as under 18.

Not only is the global rush to age gate, sapping any momentum there was to combat surveillance capitalism, it is now pushing us in the other direction embedding user surveillance as an essential part of age estimation (see the Meta Settlement, the EU Kids Act, and now Discord)

My main complaint here is not with Discord's newly rolled-out age estimation system (tho sadly it does perpetuate analysis of users' activity) but with the fact of age gating as a means to safety, rather than giving all users, including young people, the tools to create their own safe experiences.
