He’s correct that it was poorly written. It provided loopholes instead of ruling on constitutional balance of powers. Article I, Section 8 of the Constitution gives Congress the power to "lay and collect Taxes, Duties, Imposts and Excises." Tariffs are duties.

In his dissent, Kavanaugh wrote that the ruling "might not substantially constrain a President's ability to order tariffs going forward" and named the statutes the president should use instead: Section 122, Section 232, Section 301, Section 338.(2). Essentially helping Trump revise his approach.

The Supreme Court did not level a comprehensive rebuke of Trump’s tariffs and their unconstitutionality. Half remain effective. They leveled a very narrow decision that said they couldn’t file the tariffs using the International Emergency Economic Powers Act because it does not invoke “tariff”.
