The High Court has confirmed that the quashing of a local planning authority’s timely notification of prior approval does not retrospectively trigger the 56-day deemed consent rule in Sch 2, Pt 3, para W(11) of the Town and Country Planning (General Permitted Development) (England) Order 2015.

The Supreme Court has decided an important point of law in relation to the discharge of Part 7 housing duty: where a private rented sector offer is accepted or refused, the main housing duty ceases automatically, without the need for any further decision or notification to the applicant.
