That's not true. In fact, I often get two-sided ballots where the markings on one side penetrate through to the other side and show up as strays. But because the columns of the checkboxes are in different locations on front an back, the stray markings have no effect.

That's not how eminent domain works. The government has to compensate the individual in order to take anything. It still falls under the Takings clause of the 5th Amendment: "[...] nor shall private property be taken for public use, without just compensation."
