Among other concerns, it would surrender one of the Act's most important safeguards — the requirement for federal oversight of wildlife decisions — to hostile state agencies. Protected species shouldn't have to pay just so fossil fuel executives and special interests can line their pockets.

The “permitting reform” package is being called the "Bipartisan American Affordability and Jobs Act of 2026," but it's really a massive giveaway to the fossil fuel industry. This backroom deal will gut the #ESA and the Act's gold-standard “best available science” mandate.

Under the new directive, killing an endangered animal is entirely legal — so long as it wasn't "intentional." Without protection against our modern world, so many animals won’t stand a chance. So today we took legal action to challenge this directive and protect imperiled species.

We're taking the Trump admin. to court to stop it from allowing endangered species to be killed. In September, FWS director, Brian Nesvik, issued a directive attempting to strip imperiled wildlife of protections from activities that can harm or kill them. In the #ESA, this is known as "take."

The US should review policies that allow major food crops to be sprayed directly with #herbicides shortly before harvest and should tighten related policies that allow for high levels of residues of those #pesticides in finished food products.

The past decade as a whole has been deadly for whales and sea turtles, with at least 335 whale entanglements recorded off the Northeast and mid-Atlantic between 2017 and 2026. And these numbers only reflect instances when a whale is seen actively entangled.

As if that's not enough, the legislation also curtails the ability of individuals, nonprofits (including us) and communities to challenge fossil fuel projects by REQUIRING courts to tip the scales in favor of the fossil fuel industry — making it impossible to bring an environmental justice claim.

And, in order to speed up approvals for these fossil fuel projects, the legislation also guts the #EndangeredSpeciesAct by surrendering one of the Act's strongest safeguards — the requirement for federal review of project impacts. This would allow for state-run rubberstamping of dangerous projects.

Under the guise of helping renewable energy, a new legislative package, cynically titled the "Bipartisan American Affordability and Jobs Act of 2026," would give the fossil fuel industry massive long-term structural advantages and lock in thousands of fossil fuel projects.

While atrazine's harms are well known, the true scop of its pollution in the US has not been widely publicized and remains largely unknown to the general public. For the report above, we analyzed both water-monitoring and modeling data compiled by the #EPA to identify contaminated waterways.

Atrazine is one of the most widely used pesticides in the US, with about 70 million pounds deployed each year. It's also the most widespread pesticide contaminant in US water bodies and so dangerous to both people and wildlife that it has been banned in more than 60 countries across the world.

#Atrazine is single-handedly making clean water unavailable and posing long-term dangers to people and wildlife in affected areas. The #EPA, which is considering reapproving this #pesticide, should follow the lead of five dozen countries around the world and implement a permanent ban on atrazine.

The filing also says they will be initiating land condemnations outside the parks with DOJ in "coming weeks." We'll be in court tomorrow in El Paso demanding a permanent halt to the destruction. We won't let them destroy the wildest place in Texas without a fight.

The court filing says they may "consider adjustments" that would "minimize potential impacts," but they give no assurances. And this is the same boilerplate language we've heard all along, the same thing they said before they sent in the bulldozers last time around.

A commonsense solution is pop-up fishing gear, which avoids having lines in the water and is currently being used successfully in #California fisheries. Sadly, pop-up gear is not being used in the area where this entanglement occurred.

ICYMI: Another humpback whale was recently found entangled in fishing gear off the West Coast. Thankfully, rescuers were able to free the whale, which then swam free. This incident follows another entanglement of a humpback calf in the area in August. These entanglements are preventable.

SpaceX says it urgently needs the land to expand its operations. The only thing urgent is the threat this poses to crucial ocelot and shorebird habitat. Their plans could bring bulldozers, industrial development, and more dangerous rocket explosions into the refuge, putting wildlife at risk.

Trump’s action is illegal because the law requires that the fuel economy standards be set at the “maximum feasible” level. The final rule ignores the feasibility of clean technology and the millions of fuel-efficient cars already on the road.
