Bijna precies tien jaar geleden interviewden Karen Geertsema en Heleen de Jonge van Ellemeet de winnaar van de Nobelprijs voor de Vrede, Navi Pillay, voor het tijdschrift voor immigratiejuristen A&MR

In uw Mandeville lezing bekritiseert u het Europese
vluchtelingenbeleid. Wat is uw belangrijkste
boodschap?
‘Juist nu grote aantallen mensen bescherming zoeken, moet
Europa zijn eigen standaarden toepassen en die niet verloo-
chenen. Het joint statement van de Global Migration Group
over “Human rights of migrants in an irregular situation” van
2010 was een belangrijk moment. Daarin uitten VN-organen en
andere organisaties niet alleen hun zorgen over de kwetsbare
positie van illegale migranten. Ze zeiden in feite ook: “wij
staan voor de mensenrechtelijke normen die in Europa zijn
ontwikkeld en die Europa naleeft.”
Europa heeft met zijn lange traditie van beschermen van
mensenrechten een voorbeeldfunctie. Wij riepen overheden
overal ter wereld op om naar die Europese standaard te streven.
Daarom is het alarmerend dat nu in Europa een aantal kern-
waarden met voeten worden getreden. Andere landen zien dat
Europa het opeens niet meer zo nauw neemt met de normen
die het zelf heeft bepaald.
Het is belangrijk om Europeanen eraan te herinneren waar
zij vandaan komen. Waarom verdiende de Europese Unie in
2012 de Nobelprijs voor de Vrede? Tegen deze achtergrond
en kijkend naar de miljoenen Syriërs die hun land hebben
moeten ontvluchten, van wie veruit de meesten nu in buur-
landen als Libanon bivakkeren, valt het moeilijk te begrijpen

Het is zeer teleurstellend dat sommige landen denken in
termen van quota. Op die manier kunnen zij niet voldoen
aan de verplichting die de kern vormt van het asielrecht,
het bieden van bescherming aan vluchtelingen. Ook de
EU-Turkije deal druist in tegen kernbepalingen van het
VN-Vluchtelingenverdrag. Je screent mensen om te beoordelen
of ze asiel en bescherming nodig hebben, niet om ze terug te
sturen. Dat moet een individuele beoordeling zijn, ongeacht
de aantallen. Daar komt nog bij de zeer gebrekkige toegang tot
recht, inclusief rechtshulp, voor asielzoekers die in het zuiden
van Europa aankomen.
Dit laat opnieuw zien dat rechtshulpverleners en NGO’s in
actie moeten komen om schendingen van mensenrechten aan
te kaarten. Dat zie ik als de belangrijkste taak voor het maat-
schappelijk middenveld: verzamel de feiten.”

Nee, dit zou enkel van toepassing zijn op gezinshereniging voor vluchtelingen. Er wordt niet gemorreld aan de bepaling op grond waarvan Jettens partner nu al in aanmerking komt voor een verblijfsvergunning. Het feit dat het daar mogelijk blijft maakt dit voorstel zonder meer discriminatoir. 1/2

Helemaal eens met @rockandvulcan.bsky.social , maar hij hoeft niet naar het internationale recht te verwijzen. Het recht op gezinshereniging met een ongehuwde partner is verankerd in de bepalingen van het (reguliere) Nederlandse vreemdelingenrecht, al sinds eind jaren 70.

Artikel 3.14

De verblijfsvergunning, bedoeld in artikel 3.13, eerste lid, wordt verleend aan:

a. de vreemdeling van 21 jaar of ouder die met de hoofdpersoon een naar Nederlands internationaal privaatrecht geldig huwelijk of een naar Nederlands internationaal privaatrecht geldig geregistreerd partnerschap is aangegaan;

b. de vreemdeling van 21 jaar of ouder, die met de hoofdpersoon een naar behoren geattesteerde duurzame en exclusieve relatie onderhoudt, waarin de partners:

1°. niet tot elkaar in een zodanig nauwe relatie staan dat die naar Nederlands recht een huwelijksbeletsel zou vormen, en

2°. ongehuwd zijn en geen in Nederland geregistreerd partnerschap zijn aangegaan, tenzij het huwelijk door wettelijke beletselen waarop geen invloed kan worden uitgeoefend, niet is ontbonden;

Goh: ben inmiddels ruim 20 jaar Nederlander. Ik moest eraan denken omdat ik eergisteren een nationaliteitszaak voor de rechtbank Den Haag stond te bepleiten, en ik dacht ‘hoe lang heb ik zelf al de nationaliteit?’ Beatrix tekende op 2-11-05, maar de kennisgevingsbrief kwam pas enkele weken later aan

Well that’s a relief— I mailed my ballot to California three weeks ago, but when it has to cross the lines of a federal gov’t that is openly hostile to voting by mail (the State Dep’t got rid of the ballot forwarding service from the consulate in Amsterdam), nothing feels entirely certain anymore.

Cijfers Hoeveel mensen keerden uit Nederland terug naar Syrië?
Sinds de val van dictator Bashar al-Assad in december, zijn ongeveer 720 Syriërs die in Nederland verbleven teruggekeerd met de hulp van de Dienst Terugkeer en Vertrek (DTenV). Dat zijn mensen die bijvoorbeeld een tijdelijke verblijfsvergunning hadden (ongeveer 210) of een lopende asielaanvraag (ongeveer 330). Ahmad al Hosain heeft een Nederlands paspoort, waardoor hij zijn vertrek niet bij een Nederlandse overheidsinstelling hoefde te melden. Hoeveel Syriërs met een dubbel paspoort al terug zijn gegaan, is bij DTenV niet bekend.

This is an absolutely groundbreaking judgment of the Court of Justice of the EU. It means that an almost throwaway phrase in its 1993 judgment Micheletti, that Member States must have “due regard to [EU] law” when conferring nationality, has finally become operable link.springer.com/chapter/10.1...

The Court made two key statements, one relating to the terms under which member states were to recognize the nationality of other member states, and one relating to the terms under which Community law constrained the acquisition and loss of member state nationality.We will analyze them in their relationship to the historical interests of the Community and of the member states. We have seen throughout this book, guided by Van Middelaar’s scheme for viewing the “spheres” of orbit of the member states in the Community, that the member states, from their own interests as States, always preferred norms of international law.These were inevitably premised on their undivided sovereignty and their ability to determine on their own terms what legal norms they would be bound to. If one does not read Micheletti carefully, one might at first think that the Court is genuflecting before the sovereignty of the member states to determine who their nationals are.Aside from Spain, the defendant, the only member state that had intervened in Micheletti was Italy, the member state whose nationality Micheletti possessed. Thus one might have mistaken the Court’s judgment for arbitration between Spain and Italy, admonishing Spain to respect Italy’s definition of who its own nationals were. But actually, the Court was not at all uncritically adopting the Nottebohm doctrine. In fact, it inserted a crucial phrase into it: “Under international law, it is for each Member State, having due regard to Community law, to lay down the conditions for the acquisition and loss of nationality.”111 At least one commentator, D’Oliveira, correctly recognized that this phrase meant that the Court was “sticking a Community foot in the door” of the principles of international law on nationality.112 It was a largely unnecessary obiter dictum in Micheletti’s own case, and yet the Court, in the later words of the same commentator, was “firing a warning shot across the bow” of the member states.113
