And finally this. We need to stop pretending that court expansion would cause the crisis. We are already living through it. Without court expansion, the nation is done. Reform involves risks, but the nation already hangs by a thread. bsky.app/profile/nich...

But some of the other reforms (Brennan Center 18 year terms) are pure fantasy and ignore (i) that they can’t be done by statute and (ii) could never pass by constitutional amendment until Rs feel like they have something to gain. And until Ds expand the court the latter will never come to pass.

4. I also favor other alternatives. Shrinking the jurisdiction of the court is a great idea....

3. Public confidence in lower courts should be high. They do a great job. But again, that is something that should be earned. The idea that a reform should “preserve” confidence puts the cart before the horse.

2. It will take time to rebuild public confidence in the court. That already has eroded and frankly is still higher than it should be. The goal isn’t for us to preserve public confidence. That is something that should be earned.

.... Make the court much, much larger – say 27+ judges – make them sit in panels (of say 9). No en banc decisions. Give each president three appointees and no more regardless of retirements and deaths....

... Once Ds expand the Court and prevent race to bottom by winning at ballot box/preventing an R trifecta for several elections, that gives Ds leverage to seek a more responsible reform – a constitutional amendment – that Rs otherwise wouldn’t go for in a million years otherwise....

1. Democrats would need to prevent a Republican trifecta several elections in a row. That buys time. (Note that if court is not expanded very soon Roberts court makes America unrecognizable before any larger reform can happen.)...

Could you explain, what legal theory is that?

Strikes me if Democrats wanted to be more competitive in red states they would run hard against data centers and flock cameras, two issues that centrists (because of their chumminess to tech/big business) will likely not adopt. Progressives could show they are the more electable ones in red areas.

In America extrajudicial killings were frequently public lynchings – events which entire communities came to witness, eat bbq and pose for photographs. In some states, legal executions, often public, were pitched as a way to “reform” and regularize lynchings which came to be seen as embarassing.

Thank you for your response. Isn’t there a strong argument that these are some of the most serious crimes in America right now? Literally warping our democracy. In which case, shouldn’t these be a higher priority than say, drug crimes? When you say these are genuinely difficult, how difficult?

I find that article credulous of law enforcement and problematic. Do you have an opinion? If these are really violent threats (as the article alleges), shouldn’t these cases be easy to prosecute? And shouldn’t investigation be straightforward? It sounds to me like police just aren’t prioritizing.
