new preprint: The Public Interest in Private Science. It explores how government grants & contracts became central ways to fund scientific research; argues that these agreements fail to effectively protect either scientific independence or the public interest; & sketches a few possible reforms

Can relate!!! I ran into students in the hall who were going to my class but I went the wrong direction and then had to shamefully do a U-turn and follow them.

Have you tried changing the hidden ‘TOC…’ styles that appear if you ask to see all styles on the styles panel? I think this did it for me once.

If you give it a skim, I would love to hear your thoughts! If you're working on anything related, HMU! Presenting this at this year's #CSLaw was truly an honor, and the review process really helped me refine the argument. My sincere thanks to my three anonymous reviewers—reviewer # 2 _especially_!

If this seems too in the (crypto) weeds for you, can I interest you by saying that I see this problem elsewhere in privacy & surveillance? And if it seems too 2022 (Apple NeuralHash!), can I venture that the next (presumably AI…) crypto wars will have to face this head on?

All in all, this publication was 8 years in the making! A personal record!!! The slightly longer version of the titular claim is that you cannot understand the current truce in the crypto wars with the instrumental understanding of privacy that has prevailed both in legal thinking & crypto policy

The rule against viewpoint discrimination is one of the most imptl in First A law. But as I show in a new paper, forthcoming in the U Penn Law Review, the test of viewpoint discrimination has changed a LOT in the past few decades, in good ways and bad. 🧵 papers.ssrn.com/sol3/papers....

Remember the law-review author who outsourced his writing to generative AI? The one that made me say, "I now know that neither this attorney’s new article nor their old one is worth reading." He outed himself, and it turns out the article in question is as bad as I predicted. Worse, even. 1/

I myself have been using an edited CSL that adheres to R16.5 when an extra field `nonvolume-pagination` is set to true.

This is great! I'd say that a hack to a known limitation—"Nonconsecutively Paginated Journals", R16.5—is to enter those journal articles as magazine articles. Right? This goes for an increasing proportion of non-U.S. journals as well as some online companions.

OTOH, aren't gov't contractors able to impose contractual confidentiality obligations (to protect trade secrets) that defeat even FOIA? Maybe the question is whether a legitimate interest is furthered by the limitations, rather than deliberately overriding legislation for an unrelated reason?
