Folks, I get why y'all are sending around some of these Hegseth quotes, and yes, it's important to know what he's saying. But also I don't love reading trans slurs every third or fourth post, even if they are quotes from that asshole. So maybe could ya ease up, or mark as sensitive content? Thanks.

For folks following along: if lawyers don't know where someone's being held, they can't know which court would have jurisdiction, which means that they can't file a habeas petition, so there's no effective means of seeking relief. I can only imagine there will be lawsuits about this ASAP.

9th Cir. holds that it violated due process to deny bond hearings for asylum seekers who entered without admission/parole, were screened for expedited removal, and who were found to have a credible fear of persecution or torture. Thuraissigiam does not apply. cdn.ca9.uscourts.gov/datastore/op...
In sum, the government’s strictly circumscribed detention authority, a pillar of our common law tradition for almost a millennium, stands in contrast to the political branch’s “plenary authority to decide which aliens to admit.” Thuraissigiam, 591 U.S. at 139. Thuraissigiam was an admission, not a detention, case. For that reason, as well as because it was specifically limited to noncitizens at the “threshold of initial entry,” it has no application here, the government’s fervent pleas for its vast expansion notwithstanding. Id. at 107. Noncitizens who arrive illegally and are found away from the border well after arrival are protected from arbitrary detention in violation of the Due Process Clause.16  III. Conclusion The district court correctly concluded that (1) it has jurisdiction over this dispute and (2) Thuraissigiam does not bar the bond hearing class’s due process claim. The district court’s order denying the government’s motion to dismiss is AFFIRMED.

Glad folks are appalled by photos of the "phone booth" cage under an awning, but pls understand: This IG report is likely part of a cover-up. Amnesty Int'l interviewed detainees EIGHT MONTHS AGO who said the cage was half this size (couldn't stand up), had no awning, w feet chained to the bottom.

The Patriot Act, the DHS, ICE, the CBP, the invasion of Iraq in 2003, use of "enhanced interrogation techniques" (torture), extraordinary renditions, Guantanamo Bay, Abu Ghraib, broad NSA surveillance of US citizens, widespread anti-Muslim propaganda: all of these came about after the 9/11 attacks.

The maj. op. compares the Trump administration's desire for mass arrests to precede mass deportations to World War II internment camps.
e government ordered the mass detention of all individuals of Japanese descent present in the United States during World War II. Nearly 120,000 people were sent to internment camps within our borders. United States v. Hohri, 482 U.S. 64, 66 (1987). The stain of these detentions on our nation—and the judiciary’s abdication of its obligation to protect basic freedoms—continues to haunt us. See, e.g., Trump v. Hawaii, 585 U.S. 667, 710 (2018) (stating that the Supreme Court decision affirming executive policies on Japanese internment “was gravely wrong the day it was decided, has been overruled in the court of history, and—to be clear—‘has no place in law under the Constitution’” (internal quotation marks omitted)). Those shameful and abhorrent past detentions were limited in scope in comparison to the mandatory detention that the Government urges us today to find that Congress established thirty years ago in an ambiguously worded statutory provision. We decline to do so.

While we understand this line of reasoning, we cannot endorse it.  The statutory definition of “conviction” does not allow it.  There is no statutory basis for asking why the state court acted and distinguishing between substantive defects and rehabilitative purposes.  The effort to focus on state-court motive boils down to a policy judgment and an attempt to divine what Congress would do if faced with the question of vacated judgments.  But that’s not how statutory interpretation works.  See Scalia & Garner, Reading Law § 60 (rejecting the “false notion that when a situation is not quite covered by 18 a statute, the court should reconstruct what the legislature would have done had it confronted the issue”).The Board’s framework for analyzing vacated convictions may make good policy, but it is not the result of good statutory interpretation.  Because Yanez Piedra’s drug conviction has been vacated, she is not now an “alien convicted of” a controlled-substance offense.  The Board’s decision denying remand thus rested on an incorrect legal conclusion.  So Yanez Piedra’s first challenge succeeds.11  But her second challenge fails, because the regulations dealing with the timing of voluntary departure are reasonable.
