Sometimes people don’t tell the truth, even in legal filings. It’s not the reader’s job to provide the evidence. There is none here, so I don’t know what is true. Just like if the police put out a press release after an “officer involved shooting,” should be some skepticism.

I’m not saying everything is made up, rather this is a PR document put out by a law firm that tries to convince juries smoking is safe for a company with a recent history of defrauding customers and litigants. Maybe they are both on the right side of this one, but this isn’t the doc to show it.

Why, considering they recently got fined $2.5B by the FTC for defrauding customers and also was recently found to have destroyed evidence in an antitrust case? I think some skepticism is warranted.

Yes, that’s my point, the intro to the demurrer is a page and a half of irrelevant outside evidence followed by a closing sentence saying forget all that, but grant our motion for unspecified reasons. It’s a PR motion.

This is not the core of their position, this intro is entirely irrelevant to the motion and none of the supposed facts are substantiated with any evidence (not that it matters, because they’re irrelevant). Also there are typos and cases are not cited in the correct form. This is not a good motion

The Jerusalem Post calls Moss “pro-Israel” so I’m not sure it’s based only on the fact that he is Jewish. Plus there is (disputed) audio of him saying he is running to make sure the US keeps supporting Israel, who is currently conducting a genocide and helping us conduct an inhumane war.
