The North Carolina legislature should reject this bill. Election officials already update the voter rolls and monitor who’s voting. They don’t need amateurs grabbing for the wheel, especially during the busy, high stakes days of ballot counting.

Notably, election officials found 97% of the 185,000+ voter challenges in 2024 to be unfounded. Mass challenges aren’t helpful.

Voter challenges scare and confuse voters, waste enormous amounts of election officials’ time and taxpayer money, and promote the false notion of widespread voter fraud. My recent report details the various problems mass voter challenges caused in 2024. www.brennancenter.org/our-work/res...

Mass Voter Challenges
Election deniers are abusing voter roll procedures, using false claims of widespread fraud to contest people’s eligibility to be on the rolls or cast a ballot.

There’s no need for post-voting challenges. A voter’s eligibility is verified when they cast their ballots. Election officials carefully track ballots and confirm compliance with state rules. There’s no evidence that significant numbers of improperly cast ballots are sneaking through.

States should be limiting who can challenge other voters and when. Permitting challenges after voters leave the polls could cause chaos, slow down ballot counting, and cause unnecessary issues for voters who lawfully cast ballots.

This provision, should the bill pass, would make North Carolina an outlier. Most states either require challenges to be completed before Election Day or allow them to take place only when a voter gets to the polling place to vote or their mail ballot arrives. www.brennancenter.org/series/limit...

This is a recipe for chaos and disinformation. It should be rejected.

The North Carolina legislature is considering an elections bill with several problematic provisions. One changes rules for challenging ballots, allowing votes cast during early voting to be challenged up to 3 days after Election Day.

Allowing widespread challenges after ballots are in encourages people to lodge baseless complaints that slow down counting, harass voters, and spur malicious myths about the trustworthiness of the results.

Above all, the Board serves the people of Georgia. It should immediately explain to its constituents why it hired Frazier and, if it cannot provide a satisfactory justification, reconsider the decision.

The reported purpose of this hire has echoes of Trump’s attempts to persecute political enemies—including the Administration’s unprecedented raid of Fulton County’s election offices. www.brennancenter.org/our-work/ana...

The Board has real power: it can subpoena county officials and make rules that govern elections. When that power is wielded recklessly, it can hurt real people.

Transparency is another crucial aspect of investigations, but the Board hired Frazier in secret. When local media asked about his hiring, the vice chair threatened the reporter with an ethics complaint rather than explaining the decision. www.brennancenter.org/sites/defaul...

How can Frazier be independent when he’s spent years alleging problems with Georgia’s elections? His credibility hinges on finding something, even though we already know from years of high-quality probes that there is no widespread voter fraud in the state.

If the Board hires investigators, they should be people who have worked in law, elections, or auditing. Merely filing voter challenges, especially flawed ones, does not qualify someone as a seasoned investigator.

Federal guidelines emphasize that investigators must have appropriate qualifications, committed independence, and take due professional care in order to conduct high quality investigations. Frazier checks none of those boxes. www.brennancenter.org/our-work/res...

Instead, the Board has extended a years-long pattern of prioritizing conspiracy theories over common sense by secretly hiring an unqualified election denier to “investigate” supposed wrongdoing.

To help improve election integrity and public confidence in Georgia, the Georgia State Election Board must employ experienced, impartial auditors when it wants to look into issues. It shouldn’t conduct investigations under the cover of darkness. www.ajc.com/politics/202...

This order came almost exactly a year after Trump issued another EO that purported to require Americans to show a passport or other citizenship doc to register using the federal voter registration form. Multiple courts blocked the first order as an impermissible use of power. Yet here we are again.

This order is an illegal and dangerous attempt to rewrite election rules and eliminate accessible voting options that millions of Americans rely on—including older voters, voters with disabilities, active-duty military, and Americans living overseas.

Andrew Garber @andrewgarber.bsky.social · 02/04/2026
And there’s more. The order directs DHS to create a citizenship list for every state based on several incomplete and outdated databases. If created, this list would be error ridden, and compiling it would itself violate federal privacy law.

The president can’t decide who votes or how they vote, and this attempt to use the post office as way to do just that is plainly a pretense for acting on longstanding lies about mail voting. All evidence shows mail voting is safe and secure.

Andrew Garber @andrewgarber.bsky.social · 02/04/2026
Our lawsuit explains how the order violates the foundational principle of separation of powers. The Constitution gives authority to run elections to the states and Congress, not the President. Period. Full stop. End of story.

Andrew Garber @andrewgarber.bsky.social · 02/04/2026
The order would turn the postal service into a decider of whose ballots get delivered and whose don’t. By law, the postal service must deliver all mail, not just the ballots the President has declared eligible for delivery. No one, including the President, has authority to overrule this law.

This is an unconstitutional abuse of power and its drafters seem to not understand how elections actually work. Courts blocked implementation of the president’s last unconstitutional effort to take over elections, and we expect more of the same here. www.brennancenter.org/media/15454/...

These judges ignored the clear law and history. Instead, they applied a “magic words” test and decided the statute didn’t say them. Shockingly, they also said the Voting RIGHTS Act doesn’t provide for a right to vote. (5/9)
