Of the three hospitals where Lowrimore alleges she did not receive timely care, two did not respond to requests for comment. The third, Mercy Hospital, said it provides “all medically indicated” treatment to save mothers.
Lowrimore’s lawsuit, in which an OB-GYN and six women who were denied care are seeking to block the Arkansas abortion ban, is ongoing. Lowrimore also filed complaints under the same emergency medicine law as Thurman against the three hospitals. Regulators cited Mercy Hospital in Fort Smith, Arkansas, for failing to provide care during the eight hours Lowrimore waited to be seen. The other two hospitals were not found to have violated that law, and they did not respond to requests for comment.

A spokesperson for Mercy Hospital declined to comment on the case, saying that, “in tragic situations when a mother suffers from an urgent, life-threatening condition during pregnancy, Mercy provides all medically indicated treatment to save her life.”

Lawsuits describing delays in care in states that have banned abortion set us down another potential path. When we compared ectopic pregnancy death rates between states that implemented strict abortion bans after Dobbs and those that did not ban abortion, we saw a growing divide.

Prior to 2020, the rate is about 4 deaths per million in states with no ban, compared to about 5.5 in states that later implemented an abortion ban. By the 2023-2025 period, the rate is 13.1 in states with a strict ban, and 7.1 in states without a ban.

When my colleagues and I started digging around in CDC data on pregnancy-related deaths, we noticed something surprising: the rate of ectopic pregnancy deaths had more than doubled in recent years. Nearly 200 women died between 2020 and 2025. So we set out to learn why 🧵

The rate rises sharply for the 2020-2022 period and continues to increase, to 9.8 deaths per million births, in 2023-2025.

These notices describe a 10-kilometer radius around an outbreak to avoid revealing the actual site. They do give the northernmost point of the circle, and I found that plotting 5 kilometers south of that point revealed the site of the outbreak."
