Good news for voters! The Trump admin asked the Supreme Court to lift the latest block on the USPS mail-ballot rule. SCOTUS said no. That doesn’t say whether the rule is legal. For Colorado voters, the advice is still wonderfully boring: keep your voting plans.

For now, two courts are saying this can’t move forward. That means even if the Supreme Court lifts the Massachusetts block it’s considering, the USPS rule still can’t take effect. This new D.C. injunction is a separate block.

You should be able to vote without wondering whether armed ICE agents will be at the polls. Voter intimidation is illegal. The government doesn’t get a loophole. This lawsuit seeks to make clear that immigration enforcement cannot be used to intimidate or deter voters in Colorado or nationwide.

Setback
The Supreme Court pauses the first block.
The Supreme Court granted the Trump administration's request to pause Judge Talwani's June 25 ruling. That was the first of the two layers of protection, the one for Colorado and the 22 other states that sued.

The Court did not decide whether the executive order is legal. They only lifted the block while the case continues.

The second layer is still holding. Judge Talwani's August 11 nationwide order remains in place, keeping the Postal Service from carrying out the executive order in any state, including Colorado.

USPS finalized its new mail-ballot rule. Courts are still blocking it from taking effect, but USPS says it wants to be ready to implement it immediately if those orders are lifted.

The block goes nationwide.
Judge Talwani ruled again, this time in the League of Women Voters case, one of the other lawsuits from April.

Her new order blocks the executive order across every state for the November election.

Her reasoning: with less than 90 days before the midterms, it is too late to change how mail voting works. And the record contains no evidence of non-citizens voting by mail that would justify the order in the first place.

There are now two independent layers of protection. One for the states that sued in April. One for every voter, nationwide.

Today, Colorado joined 22 states and DC in urging the Supreme Court to reject Trump’s bid to revive his mail-voting order before November. Trump’s lawyers say the plan is too unfinished to challenge, but too urgent to keep blocked. Convenient.

A big election story this week. The FBI raided the Ohio Organizing Collaborative, a voter registration nonprofit, seizing equipment and questioning staff. Federal authorities haven't said why.
