Max Uthoff: Ich hatte ganz aktuell einen Auftritt bei Till Reiners, in dem ich ein Wort benutzt habe für eine Form von Autismus, das nicht benutzt werden sollte. Das habe ich jetzt verstanden und gelernt. Vor allem, weil es keine sieben Minuten gedauert hat, bis mir meine 17-jährige Tochter dermaßen den Arsch aufgerissen hat! Ich hoffe nicht, dass ich autistischen Menschen damit zu nahe getreten bin. Ich wollte Elon Musk möglichst hart beleidigen und habe mich in einer Argumentation verstiegen, die nicht schlüssig war.

Bayern hat letztes Jahr im Oktober noch (still & heimlich?) die Meldedatenverordnung geändert?! "Frühere Vornamen und Geschlechtseinträge werden nun bei Änderungen automatisch an das Landeskriminalamt übermittelt"

Wichtig zu beachten für alle Personen, die in Bayern leben und das SBGG-Verfahren nutzen möchten oder die ihren Geschlechtseintrag und/oder ihre Vornamen bereits geändert haben (auch nach TSG und PStG-Verfahren) und neu nach Bayern ziehen:

Das Bayrische Staatsministerium des Innern, für Sport und Integration hat die Bayrische Meldedatenverordnung mit Verordnung vom 10. Oktober 2024 (GVBl. S. 545) geändert.

§ 6 der Verordnung sieht vor, dass bei einer An- oder Abmeldung (in Bayern), einem Sterbefall, einer Änderung des Geschlechtseintrags oder einer Namensänderung automatisch frühere Vornamen und der frühere Geschlechtseintrag an das Landeskriminalamt übermittelt werden (https://www.gesetze-bayern.de/Content/Document/BayMeldDV-6).

§ 9 sieht vor, dass die Daten von Personen, die eine Waffenbesitzerlaubnis haben oder gegen die ein Waffenbesitzverbot erlassen wurde an die Waffenerlaubnis-behörden übermittelt werden. Eine Übermittlung erfolgt bei Zu- oder Wegzug, einer Änderung der derzeitigen Anschrift im Zuständigkeitsbereich der Meldebehörde, einem Wohnungsstatuswechsel, einem Sterbefall oder einer Änderung des Geschlechtseintrags oder einer Namensänderung.

Die Personenstands-Antwortkategorien „männlich“, „weiblich“ und „divers“ können trans*, inter* und nicht-binäre Personen nicht erfassen, da "divers" eine Fremdbezeichnung ist. Diese Kategorien sollten deshalb nur verwendet werden, wenn der Personenstand zentral für die Forschungsfrage ist. (S.18) ⬅️

Erstens belegen die Ergebnisse, dass die Geschlechter abfrage über die Kategorien „männlich“, „weiblich“ und „divers“ eine ungeeignete Methode ist, um geschlechtliche Vielfalt in ihrer gelebten Realität zu erfassen, da es sich bei der Bezeichnung „divers“ um eine empirisch kaum verwendete Selbstbeschreibung von TIN*-Personen handelt. Dies lässt darauf schließen, dass auch die Problematik der geringen Fallzahlen der „divers“ Kategorie entschärft wird, wenn die Abfrage von Geschlecht mehr Raum für geschlechtliche Vielfalt bietet.

6 Empfehlungen zur Erhebung von Geschlecht
Auf Basis des bisherigen Forschungsstandes sowie der empirischen Ergebnisse dieses Beitrags lassen sich eine Reihe von Empfehlungen für Forschende ableiten. Im Ein klang mit den Prinzipien guter wissenschaftlicher Praxis empfehlen wir, dass hierbei stets das Forschungsinteresse beziehungsweise die Forschungsfrage der Untersuchung im Fokus stehen sollte, anhand derer die passende Erhebungsform von Geschlecht zu bestimmen ist. Zur Bestimmung der Erhebungsform empfehlen wir ein vierstufiges Vorgehen (siehe Abb. 2). Zunächst sollte das Forschungsinteresse beziehungsweise die Forschungsfrage der Untersuchung bestimmt werden. Darauf aufbauend kann die benötigte Dimension von Geschlecht abgeleitet werden.

Es fällt auf, dass die meisten der betrachteten Studien das Konzept Geschlecht nicht näher definieren und teilweise unterschiedliche Instrumente genutzt werden. Besonders häufig werden die Antwortkategorien „männlich“, „weiblich“ und „divers“ verwendet, obwohl in der Frage nicht explizit nach dem Personenstand gefragt wird. Damit etabliert sich eine Praxis der Abfrage von Geschlecht, die den juristischen Personenstand adressiert, ohne dies konkret zu benennen, und weniger auf die Abbildung von geschlechtlicher Vielfalt im Kontext von geschlechtlicher Identität eingeht. Besonders in sozial wissenschaftlichen Befragungen kann davon ausgegangen werden, dass der Personenstand nicht (immer) die Dimension von Geschlecht ist, welche versucht wird zu erfassen. Wir sehen hierbei sowohl die mangelnde Beachtung der Mehrdimensionalität von Geschlecht in Form von fehlen den Definitionen als auch die Auswahl der Kategorien kritisch.
