Because the process should just be a Judge asking the Executive Branch if the person before them meets the requirements, and then asking if it has any objections. If there aren't any, the dude gets the thing. If not, we let an adversarial process WITH LAWYERS go forth.

You can get into an actual court if they don't follow procedure, or you have a constitutional claim. Otherwise, everything going on right now is considered to constitute "Due Process". This is bullshit and needs to be reformed. Ideally by splitting it out into the Judiciary, where it belongs.

He's not a Judge. His commission isn't under Article III. The Immigration "Courts" are part of the Department of Homeland Security, and their staff (including "Judges") are Executive Branch Employees. Nothing in there is legally a criminal matter, so you don't have a right to an attorney.

I think the problem right now is that everyone making decisions is in power because of war: Hamas controls Gaza because it fights Israel. Bibi's party wins elections because they fight Hamas. Step One to peace is making the leaders on both sides STOP having those aligned interests.
