This is not a finish line. The travel ban still denies visas after Chief of Mission approval. No one is freed from CAS. Refugee processing has not restarted. Compliance is the next fight, and this administration has a track record of slow-walking court orders.

afghanevac.bsky.social @afghanevac.bsky.social · 11/05/2026
The court also ordered both sides to rewrite the visa interview emails sent to Afghan applicants. For the first time, applicants will be warned that the travel ban blocks their visa, before they make a costly, dangerous journey to a predictable denial.

The numbers, starting in June. 1,000 SIV cases. Then 2,000 in July. Then 3,000 in August and September. Then 4,000+ every month until the backlog clears. For the first time, the slowdown is on the record as a compliance failure, not a policy choice.

afghanevac.bsky.social @afghanevac.bsky.social · 11/05/2026
On May 8, in Afghan and Iraqi Allies v. Rubio, Judge Tanya Chutkan signed an enforcement order with real teeth. Monthly processing benchmarks. Public compliance reports every month. Court-ordered fixes to misleading applicant emails. All on the public docket.

In a fight where wins are rare, this one matters. A federal judge just ruled the State Department “woefully failed” Afghan SIV applicants, and ordered enforcement. This win belongs to @irap.bsky.social, who never let the case go quiet. 🧵👇

His name is Mohommad Nazeer Paktyawal. He fought alongside U.S. Special Forces. He was a father of six. He should still be alive.

afghanevac.bsky.social @afghanevac.bsky.social · 17/03/2026
We need answers: - Why was he detained? - What medical care did he receive? - Why was the inhaler not provided, especially if identified during arrest? - What caused his death?
121
afghanevac.bsky.social @afghanevac.bsky.social · 17/03/2026
Even if every allegation were true, it would not change this: A man died in government custody in less than 24 hours. The punishment for fraud is not death.
141
afghanevac.bsky.social @afghanevac.bsky.social · 17/03/2026
At the same time, DHS is trying to change the subject. They are calling him a “criminal” based on allegations that were never adjudicated. Allegations are not convictions.

afghanevac.bsky.social @afghanevac.bsky.social · 17/03/2026
Reporters should be working to confirm: - What ICE was told - What care he received - What happened between arrest and hospitalization A medical investigation is ongoing.

afghanevac.bsky.social @afghanevac.bsky.social · 17/03/2026
ICE says he complained of shortness of breath. That matters. Because now the question is simple: Was a known, available inhaler provided to him when he needed it?
131
afghanevac.bsky.social @afghanevac.bsky.social · 17/03/2026
His wife says she told officers during the arrest that he needed it. She says she tried to give them the inhaler. She says they refused. This is what the family meant when they said he was “denied care" in their statement.
222
afghanevac.bsky.social @afghanevac.bsky.social · 17/03/2026
The family has provided a photo of the inhaler, shared at the top of this thread. It appears to be an albuterol rescue inhaler used for breathing issues.

Early on, when we asked the family about health concerns, they told us none. As they process an unimaginable loss, more details are emerging. We now understand he sometimes relied on an inhaler.
