New Mexicans deserve better. No one should have to avoid accessing health care, school, or jobs out of fear of racial profiling by ICE, and no child should live in fear of separation from their parents. ICE must be held accountable for the human consequences of its reckless practices.

These incidents and others raise urgent questions about unlawful arrests and due process violations in federal immigration enforcement, particularly now that agents are operating near places once considered off-limits, like health clinics.

And yet the one-year-old was held for about five hours. While ICE eventually released the baby and their mother, with an ankle monitor, ICE continues to detain the baby’s father and uncle.

Another reported incident occurred over the weekend, in which ICE stopped a family, including a one-year-old U.S. citizen baby, and detained them based on mistaken identity. ICE later admitted that they were targeting someone else with a similar last name.

One of the reported incidents on Wednesday was a parent detained in the parking lot of the La Familia health clinic. Federal immigration officials reportedly followed a parent and a child as they drove from their home to the clinic and then arrested the parent in the parking lot.

There were 418 instances of ICE pushing, shoving, tackling, and pinning people during enforcement actions in 2025. An additional 150 incidents involved people engaged in activities protected by the First Amendment, including protestors, legal observers, elected officials, journalists, and clergy.

In 2025 alone, 155 U.S. citizens — including Indigenous people — were detained. An additional 30 legal permanent residents or green card applicants and 10 DACA recipients were detained.

Before the NMCRA, people with legitimate civil rights cases were forced into federal court, where qualified immunity often shut the courthouse doors before a victim ever had a real chance to be heard.
