it's just all sort of this joke, like there are "rules" in prison, sure, but obviously not all of them are enforced all the time and thus they largely serve to discipline people who get on someone's nerves or are perceived as troublemakers.

it's just selective enforcement by guards. people have them, and if a guard hates your guts or gets mad, they can get you in trouble.

I don't understand this either. I assume this is partially why they stopped updating the tracker for people in ICE custody -- they are probably moving people around to make it look like something is happening and then releasing them in some other state, so it's hard to piece together.

It's a lot of things, of course, but I think if you look at this deployment of federal cops, it's largely designed to quash the idea of local control. The legal community isn't really ready for this, I don't think, because local control has long been a conservative thing.

Suggests to me that legal doctrines simply aren't fixed or neutral and the liberal reliance on them for the arc of justice was perhaps misplaced. (This might be a "no duh" realization, but I am a lawyer and it took me a minute to figure it out.)

Local sovereignty was, of course, the legal argument the Confederacy made to continue white supremacy, and, like most other legal doctrines designed to protect minority populations, it's being flipped so that "nullification" is now something local leaders do to fight fascism.

yeah, i mean nowadays most capital cases aren't capital cases because 1) lawyers are better at talking prosecutors into downgrading them before trial starts; and 2) defendants really don't want to be on death row.

I think if people understood that a lot of things are on the books to help prosecutors and police coerce confessions and pleas, that might alter their view. But there are, indeed, people who do terrible things, and those people give the public permission to accept a lot of cruelty.

Upon reflection maybe that is something that makes me extra upset -- keeping draconian punishments bc prosecutors know they can get people to cop a plea to avoid execution or life in prison. You don't need to use it for it to be a threat.

I have long thought that getting rid of the death penalty is just too difficult for Americans because of our history. Prosecutors mostly want it to coerce plea deals.

Yeah. SCOTUS is mostly at fault bc of Jones v Mississippi. I do think those sentences are less common although the Miller resentencings have been a mixed bag. It's another case of, it's a lot less common and also few want to outlaw the practice altogether.

I used to agree, but now I kinda worry the definition is trending the other way. Like, I remember when most people wanted to give juveniles sentenced to life a chance at parole, and then people were like j/k hate those kids.

and we also know the death penalty isn't about victims because those who kill in self-defense end up in prison. it's just a cruel system purging expendable people to justify all the apparatus.

most of the time, victims want the execution because prosecutors have told them this is will "close the book" on the case. that's just a lie. victims who don't want the death penalty are just ignored.

lots of people favor the death penalty. imho better to just admit it than to pretend like you are an abolitionist except for some people. once you actually look into the inner working of a capital case, however, you can never see the system the same way.
