My initial take on the criminal law governing the ICE shooting in MN: 609.066 of the MN Code controls a self-defense claim for a "peace officer" under state law. I'm not going to consider federal law given the capture of the DOJ by the Trump administration. 1/

The burden of proof is on the government to prove beyond a reasonable doubt that the officer was not acting in self-defense. Based on the two videos I've seen, the officer likely has a viable argument based on the first shot into the vehicle. 2/

Hard disagree here, the videos I have seen show him pulling his firearm as she’s backing up the car and his feet are clearly out of the way of her vehicle when he fires the first shot

At that moment, it would be difficult for the state to disprove beyond a reasonable doubt that an "objectively reasonable officer would believe ... that such force is necessary... to protect the peace officer or another from death or great bodily harm." The rule is very favorable to officers. 3/
