It’s right here in the 2011 Code. Trans people have never needed a GRC to access single-sex services. It’s always been on the basis of “the gender role in which they present”. The ignorant SC had no idea how trans people pee, and got absolutely played. www.equalityhumanrights.com/sites/defaul...

If a service provider provides single- or separate sex services for women
and men, or provides services differently to women and men, they should treat transsexual people according to the gender role in which they present. However, the Act does permit the service provider to provide a different service or exclude a person from the service who is proposing to undergo, is undergoing or who has undergone gender reassignment. Given that the SC refused to hear any trans people and relied mainly on hate groups for 'information', and Hodge is documented as a homophobe and is a member of the same church in Edinburgh as JKR, maybe they weren't tricked but wanted to harm trans people.

Ah, but don't you know EHRC was "captured" back in 2011 and didn't know better & that their lawyers didn't agree, but they decided to put it in anyway because they didn't care what their lawyers thought. & the government was also "captured" and did not feel safe enough to refuse to make it law /s /s
