Once again, without that power they are not a coequal branch, ergo they must have that power, explicitly stated in the Constitution or not. I would argue that "in all cases in Law and Equity" is where judicial review exists in Article 3, so it IS in the Constitution, just not in those words.

The issue is more that when they make a ruling, it is should be treated as advisory, not as overturning the law. Congress should take their rulings as something to work on to revise a law, not that they can overturn the laws that Congress makes.

And that renders the Judiciary a non-co-equal branch. It takes away the only check it has on Congress or the Exec. The Framers set up 3 equal branches, not 2 and an advisory board. The problem isn't that they have the power, it's in how the Roberts Court has chosen to use it.
